3.4.1.7 Weekly payments - other circumstances
Weekly payments for a single day
Where a worker has returned to work and provides a Certificate of Capacity Ongoing certificate is issued for up to 28 days and can be issued by a: medical practitioner, osteopath, physiotherapist, chiropractor. for one day off work, weekly payments must be calculated on the basis that the worker has a CWC Current Work Capacity for the whole of that week.
CWE Current Weekly Earnings for that week must be used to calculate the weekly payment entitlement.
Where there is a weekly payment made for a period of time within that week, it is included in the calculation of the entitlement periods for 13 and 104/130 weeks and the inclusion of overtime and/or shift allowance Under the legislation, unless inconsistent with the context or subject-matter — shift allowance means an allowance or loading paid or payable for shift work or working on public holidays, Saturdays or Sundays up to 26 or 52 weeks.
5 days PIAWE = $1,000 x 80% (weekly payment entitlement) | $800 |

Weekly payments - RTW/clearance mid-week
Partial RTW Return to Work (no prior RTW)
Where a worker makes a partial RTW mid-week (e.g. Wednesday) and are totally off work prior to the scheduled RTW the Agent should obtain CWE for the full week the RTW occurred, and pay 02 compensation for the relevant week.
Full time RTW (no prior RTW)
Where a worker makes a full time RTW mid-week (e.g. Wednesday), and are totally off work prior to the scheduled RTW the Agent should pay 01/03 compensation (based on certification) for the days leading up to the scheduled full time RTW.
Full time RTW (partial RTW prior)
Where a worker makes a full time RTW mid-week (e.g. Wednesday) and are completing a partial RTW prior to the scheduled full time RTW, the Agent should obtain CWE for the full week the full time RTW occurred, and pay 02 compensation for the days where a certificate exists.
In the case of the above example, the Agent would pay 02 compensation for the Monday and the Tuesday. No further compensation is payable.
