6.2.1.6 Interest on IB & maims claims

The legislation outlines when an employer or WorkSafe is liable for an additional payment of compensation if a court finds that there has been an ‘unreasonable’ delay in payment of compensation.


Request is made by worker or their legal representation

If a request is made by the worker or their legal representative for interest on payment of compensation either by written correspondence or by proceedings in the Magistrates’ or County Courts, the Agent must contact WorkSafe immediately before making any payments.

Request is made by legal panel firm

If a request is made by a legal panel firm for payment of compensation of a litigated Maims claim, the Agent must contact WorkSafe immediately before making any payments.
