5.1.4 Terminate weekly payments

Before issuing a termination notice assess the worker’s reasonable efforts as discussed in section 5.1.1.

If it has been determined that a worker has not made reasonable efforts to comply with the suspension notice, the Agent may terminate their weekly payments.


Contents of a termination notice

If a worker’s weekly payments are to be terminated, the notice must contain:

  • advice that their weekly payments are being terminated
  • a description of what action/inaction has been considered non-compliant
  • include actions/inaction occurring since the suspension notice was issued
  • appeal rights.
Notice period

The termination can take effect the day after the end of the suspension period.

Agents are required to allow the full period of 28 days to elapse before determining whether non-compliance has continued for the entire period. This determination should, where possible, take place the following day.

Example 1 (notice emailed):

Date that the 28 days expires: 16 November 2021
Date from which the termination can take place: 17 November 2021

Example 2 (notice sent by mail):

Date that the 28 days expires: 18 November 2021
Date from which the termination can take place: 19 November 2021
