4.5.19.6 Engage a builder

On finalisation of the plans and signoff, the BPM Building Project Manager will obtain tenders from builders to complete the modification works and the Agent will draft the Capital Services Agreement.

Tenders from builders

The BPM will obtain tenders from builders to complete the modification works. The BPM is required to provide three quotes and recommendations to the Agent within 20 business days.

The BPM will detail why the recommended builder is the best option and they should also comment on whether the cost is reasonable for the works, when the builder can commence, the timelines for the works and outline any other relevant issues, such as permits required, council issues, etc.

Capital services agreement

The Agent should review the cost of the proposed home modifications in order to draft the Capital Services Agreement which are available in the forms section of this manual.

Agent claims staff must liaise with the senior legal manager (SLM Senior legal manager) or relevant legal/thechnical representative to enable the Capital Services Agreement to be prepared. Claims staff may be asked to provide details of:

  • worker’s solicitors
  • owner/s of the property to be modified
  • other signatories to the contract
  • any guardianship issues
  • cost of the home modifications
  • name of builder.

Once finalised, a copy is required for each of the following:

  • Agent
  • worker
  • other signatories to the contract.

The Capital Services Agreement should be sent to the worker as soon as possible.

If a worker would like their solicitor to review the Capital Services Agreement before they sign it, the Agent can pay up to $250 in legal costs.

If the worker does not return the Capital Services Agreement within 10 business days, the Agent should follow up the worker.

Once the worker returns the signed Capital Services Agreement, the Agent team manager/senior manager or SLM should sign the agreement on behalf of the Agent and a copy of the completed Capital Services Agreement (with both signatures) should be returned to the worker.

Should the worker disagree with any suggested modifications, they have the usual right of appeal as per the decision notice. In these circumstances the Agent should contact WorkSafe advising of the issues at equipment@worksafe.vic.gov.au.
