3.3.6.1 Payments for periods from 13 November 2013

Claims for weekly payments received by the Agent on or after 1 November 2010

First entitlement period First entitlement period, in relation to a claim for compensation in the form of weekly payments made by a worker means an aggregate period not exceeding 13 weeks (whether or not consecutive) in respect of which a weekly payment has been paid or is payable to the worker

If the worker has: Pay the lesser of:
No current work capacity
  • (PIAWE less deductible amount) x 95% or
  • twice the State average weekly earnings for the relevant financial year less any CWE
Current work capacity
  • (PIAWE less deductible amount) x 95% minus any CWE or
  • twice the State average weekly earnings for the relevant financial year less any CWE

Second & post second entitlement period

If the worker has: Pay the lesser of:
No current work capacity
  • (PIAWE less deductible amount) x 80% or
  • twice the State average weekly earnings for the relevant financial year less 80% of CWE
Current work capacity
  • (PIAWE less deductible amount) x 80% minus 80% of any CWE or
  • twice the State average weekly earnings for the relevant financial year less 80% of any CWE

First entitlement period

If the worker has: Pay the lesser of:
No current work capacity
  • 95% of PIAWE less any CWE or
  • twice the State average weekly earnings for the relevant financial year less any CWE
Current work capacity
  • 95% of PIAWE less any CWE or
  • twice the State average weekly earnings for the relevant financial year less any CWE

Second & post second entitlement period

If the worker has: Pay the lesser of:
No current work capacity
  • 80% of PIAWE less 80% of any CWE or
  • twice the State average weekly earnings for the relevant financial year less 80% of any CWE
Current work capacity
  • 80% of PIAWE less 80% of CWE or
  • twice the State average weekly earnings for the relevant financial year less 80% of CWE.

  • the statutory maximum for the relevant financial year (currently $2,060) less any CWE

Second & post second entitlement period

If the worker has: Pay the lesser of:
No current work capacity
  • 80% of PIAWE less 80% of any CWE or
  • the statutory maximum for the relevant financial year (currently $2,060) less 80% of any CWE
Current work capacity
  • 80% of PIAWE less 80% of any CWE or
  • the statutory maximum for the relevant financial year (currently $2,060) less 80% of any CWE
Pre 12 November 1997 claim
